The Regulatory Reform Order 2005 places a legal obligation on the building owner, manager or occupier, aka the Responsible Person, to carry out a detailed Fire Risk Assessment of their premises. The basic guidance has not changed under the provisions of the Fire Safety Act 2021, except for the requirement to ensure the effectiveness of entrance doors to each residential unit and to check that compartmentation has not been compromised.
If you fail to commission a full internal Fire Risk Assessment of your premises, you will be in breach of law and could be liable to criminal prosecution.
Other implications for your business will relate to your insurance company. Should you suffer a fire at your premises, your insurance company will inspect your documentation to make sure you have been compliant with current regulations. If the insurance company deems you to have been non-compliant with legal requirements, this will create difficulties with your claim.
